These Terms & Conditions apply to the use of the Keystonez Construction website and to inquiries, quotes, bookings, and services provided by Keystonez Construction, operated by 774026 NB Corp in New Brunswick, Canada. By using our website, requesting a quote, booking a service, accepting an estimate, or allowing work to proceed, you agree to these Terms & Conditions.
1. About Keystonez Construction
Keystonez Construction provides residential construction, renovation, deck building, painting, demolition, moving, lawn care, and related services in Fredericton, Saint John, and surrounding communities. Our goal is to provide reliable, professional, and practical residential services with clear communication, written quotes, and responsible project delivery.
2. Website Use
The content on this website is provided for general information only. We make reasonable efforts to keep information accurate and current, but we do not guarantee that all website content is complete, error-free, or suitable for every situation.
You agree not to misuse this website, submit false information, interfere with website security, or use the website for unlawful purposes.
3. Quotes and Estimates
Quotes or estimates may be provided after a phone consultation, email exchange, photo review, or site visit. Unless stated otherwise in writing:
- Quotes are based on the information available at the time they are prepared.
- Quotes may change if the project scope, materials, site conditions, labour requirements, or client instructions change.
- Estimates are not final invoices unless clearly stated.
- Written approval may be required before work begins.
- Material pricing may change depending on supplier pricing and availability.
Any additional work outside the original approved scope may require a revised quote, change order, or written approval.
4. Deposits and Payment
Some projects may require a deposit before scheduling, purchasing materials, renting equipment, or beginning work. Payment terms will be outlined in the quote, invoice, or written agreement.
Unless otherwise agreed in writing, payment is due upon completion of the work or according to the payment schedule provided. Late payments may result in delayed work, suspension of services, collection action, or additional administrative charges where permitted by law.
Deposits may be non-refundable in whole or in part where materials have been purchased, labour has been scheduled, equipment has been rented, or business costs have already been incurred.
5. Scope of Work
The scope of work will be based on the approved quote, written agreement, invoice, email confirmation, or project documentation. The client is responsible for reviewing the scope carefully before approving work. If something is not listed in the approved scope, it may not be included in the quoted price.
Additional charges may apply for:
- Hidden damage, rot, mould, or structural issues
- Electrical, plumbing, or mechanical issues
- Hazardous materials or asbestos-related concerns
- Additional demolition or disposal
- Client-requested changes
- Material upgrades or substitutions
- Permit-related changes
- Weather-related protection or delays
- Extra labour or equipment not included in the original quote
6. Permits and Compliance
Some construction, deck, renovation, demolition, or structural work may require municipal permits, inspections, or approvals. Permit responsibility will be discussed before the project begins.
The client must not request work that violates building codes, safety rules, permit requirements, property rules, or applicable laws. Keystonez Construction reserves the right to refuse, pause, or stop work if unsafe, unlawful, or unsuitable conditions are identified.
7. Client Responsibilities
Clients are responsible for:
- Providing accurate project information
- Ensuring access to the property at agreed times
- Removing valuables, fragile items, pets, and personal belongings from work areas
- Advising us of known hazards, damage, restrictions, or property issues
- Securing permissions from landlords, property owners, condo boards, neighbours, or building managers where required
- Ensuring utilities, parking, elevators, loading areas, and site access are available where needed
- Reviewing quotes, invoices, and project documents carefully
Delays caused by lack of access, incomplete information, unsafe conditions, or client changes may result in additional charges.
8. Construction, Renovation, Painting, and Deck Work
Results may vary depending on existing site conditions, property age, previous workmanship, weather, material availability, and client-selected materials. Keystonez Construction will make reasonable efforts to perform work professionally and according to the approved scope.
Unless specifically stated in writing, quotes do not include engineering, architectural drawings, permit fees, hazardous material testing, major structural remediation, or hidden-condition repairs.
9. Demolition and Disposal
Demolition services are limited to the approved scope of work. Additional charges may apply for:
- Unexpected material volume
- Hazardous materials
- Special disposal requirements
- Extra labour
- Dump fees
- Sorting, recycling, or transport beyond the original estimate
Clients must disclose any known hazardous materials, asbestos concerns, mould issues, structural weakness, or contamination before demolition begins.
10. Moving Services
For moving services, clients are responsible for ensuring that all items are properly packed unless packing services are specifically included in the quote. Keystonez Construction is not responsible for damage caused by:
- Poorly packed boxes
- Previously damaged or weakened furniture
- Fragile items not disclosed before the move
- Items packed by the client
- Unsafe access areas, icy walkways, narrow stairways, or structural limitations
- Items that are too large, heavy, unsafe, or unsuitable to move without special equipment
We reserve the right to refuse to move hazardous, illegal, unsafe, excessively heavy, or improperly prepared items.
11. Lawn Care and Seasonal Services
Lawn care and seasonal services may be affected by weather, ground conditions, property access, and equipment availability. Keystonez Construction may reschedule services due to rain, unsafe conditions, equipment issues, or circumstances outside our control.
The client is responsible for removing obstacles, pet waste, toys, wires, hoses, stones, and fragile items from the lawn or work area before service.
12. Cancellations and Rescheduling
Clients should provide reasonable notice for cancellations or rescheduling. Cancellation fees may apply where:
- Materials have already been purchased
- Labour has been scheduled
- Equipment has been rented
- Travel time has been incurred
- Work has already started
- The cancellation causes a direct business cost
13. Weather, Delays, and Unforeseen Conditions
Project timelines are estimates only and may be affected by:
- Weather
- Supplier delays
- Material shortages
- Illness or staffing availability
- Permit or inspection delays
- Site access problems
- Hidden damage or unexpected site conditions
- Client changes or delayed approvals
Keystonez Construction is not responsible for reasonable delays caused by circumstances outside its control.
14. Warranty and Workmanship
Keystonez Construction aims to provide quality workmanship and will address reasonable workmanship concerns brought to our attention within a reasonable period after completion. Warranty coverage, if any, will depend on the type of service, materials used, manufacturer warranties, and the written agreement for the project.
Warranty does not cover:
- Normal wear and tear
- Misuse, neglect, or lack of maintenance
- Weather damage
- Damage caused by others
- Movement, settling, moisture, rot, mould, or hidden pre-existing conditions
- Client-supplied materials
- Changes made by the client or another contractor after completion
15. Materials and Client-Supplied Products
Where Keystonez Construction supplies materials, we will make reasonable efforts to use suitable materials for the approved scope. Where clients supply their own materials, Keystonez Construction is not responsible for product defects, shortages, incompatibility, warranty issues, or performance problems related to those materials.
Manufacturer warranties, where applicable, are provided by the manufacturer and not by Keystonez Construction.
16. Safety and Insurance
Keystonez Construction intends to operate with appropriate business insurance and safe work practices. Clients must provide a reasonably safe work environment.
We may refuse, pause, or stop work if we identify unsafe conditions, aggressive behaviour, hazardous materials, unsafe access, severe weather risks, or other concerns that may endanger workers, clients, property, or the public.
17. Photos, Reviews, and Marketing
We may ask for permission to take photos of completed work for records, quality control, or marketing. We will not intentionally publish private identifying details without consent.
Clients may request that project photos not be used publicly.
18. Limitation of Liability
To the maximum extent permitted by law, Keystonez Construction is not liable for indirect, incidental, special, or consequential damages, including loss of use, loss of income, loss of enjoyment, or delays.
Where liability applies, it is limited to the amount paid by the client for the specific service giving rise to the claim, except where the law does not allow such limitation. Nothing in these Terms limits any rights or remedies that cannot be limited under applicable law.
19. Privacy
Use of our website and services is also governed by our Privacy Policy.
20. Third-Party Links
Our website may contain links to third-party websites or platforms. Keystonez Construction is not responsible for the content, accuracy, policies, or practices of third-party websites.
21. Governing Law
These Terms & Conditions are governed by the laws of the Province of New Brunswick and the applicable laws of Canada. Any disputes will be handled in the appropriate courts or dispute resolution forums in New Brunswick, unless otherwise required by law.
